Here is my conspiracy theory...

ADV thought they were on track to get hard tops, but APG kept dropping the ball and delaying.

Lite Brite releases a video bragging about their new APG hard top, and they let the cat out of the bag that APG is doing hard tops.

ADV sees the video and says "WTF! You owe us 800 hard tops, why is Lite Brite jumping the line and getting a hard top before our 800 pre-orders?"

APG shrugs and says "talk to our lawyers, we own the patent, and we don't owe you anything."

/End Story.

My understanding of the matter is that the primary delay was because ADV's own design didn't work for mass production on the injection molds. Anyone that has worked with China on high volume mass production knows it's a completely different ballgame
there. ADV started promising things before there was any verified production, They should have not been taking orders until they knew it was ready for mass production. There are stacks of bad tops from the first run of manufacturing suffering from the injection mold separation problem. APG was going to correct these design problems and get them a new supplier to manufacture these things. FWIW, I have no skin in the game, so will be watching to see how all this pans out.

Wow. They really just said that they won't be able to refund anyone their money unless you're able to dispute it through your credit card company.

I'm sure that'll play out just fine for them...
Sounds like the money is all gone and those that waited and chose to stay on board a sinking ship for the last 1-2 years will go down with it. Sad two manufacturers are suing each other...nobody ever wins and loyal customers get screwed.

Here's my take on this... and I read 80% of the suit AFC filed.

I believe AFC was promised the world. APG took AFCs money and invested it into their own productions of the product and had no plans to keep AFC in the loop. I dunno what documents they both signed back and forth but it sounds a little like how Facebook started.

AFC put up 4.4 million which had a lot $$ from pre-orders. Now, they may be able to re-coop that but it's going to take years of battling APG unless APG settles. Now APG had already settled some other suits it seems but I didn't dive into those yet.

What is VERY ODD is how AFC is NOT refunding people. They are telling customers to file a CC dispute basically. That's a bit weird because with a CC dispute, the money gets debited from AFC's account anyway. UNLESS they change bank accounts and CC companies and/or they file for bankruptcy protection, which would allow them to operate while not having to pay debts for the time being.

Sooo yeah that part is a bit weird to me. They don't have the $$ obviously to refund everybody but at the same time if people file CC disputes they WILL have to pay it anyway..

So yeah... this will be interesting.

I have my own issues with APG but that's a story for another day, surely not as crazy as what is going on here.

Well, I was busy today ay work and no chance to check in here. I check here daily even though I'm in the 2DR crowd. I get home and see this thread on my New Post section. I click on it. HOLY F%$#K this thing jumped 10/15 pages from yesterday when I checked in. OMG did ADV finally come through, or so I thought. I started reading and all I have to say is WOW. What a shit show. There is a whole lot of he said she said BS going on here.

I've seen this scenario somewhere before. :unsure: Oh yeah, I can't post it here though. :(

same experience with Anderson. bailed on ADV and got refunded in March. Ordered anderson, was told 28-32 weeks, 8 weeks later got the shipping notification and paid for it, top was in my hands 9 weeks from order date.
I feel lucky to have dodged this one!
