Does Insurance Cover Silver Lake Dunes

Hi guys,

I’m planning on taking out my 23’ Black Diamond on the Silver Lake Sand Dunes this weekend and I called my insurer (S.F.) and they said any damage off-road is not covered. However I have found that they consider a road to be any place open to the general public and maintained…ie sand roads on a beach. Anyone have any experience with getting any other insurance for going there or do you think that I’m covered? Thanks!

If your lawyer can prove that you were on a maintained, recognized road (he’ll probably use published maps) then you might win your case. Maybe. But then, what kind of damage do you expect to happen when you are on a well maintained road?

(FYI SF is on a non-renewal binge for the least little accidents. My wife had a parking lot fender scrape; they paid, but then next year…)

You can get insurance specifically for off-road. Most companies offer it, typically as a 'rider' or add-on to your existing policy. I'm surprised your agent didn't try to sell you one.

And now that you've told them you intend to go off-road, you can be sure they'll scrutinize any claims that could be related.

Although there may be some coverage (assuming no off-road use exclusion exists) for off road damage, your collision deductible will be applied and the damage will be considered to be an at fault accident, thus your insurance rate will increase and you might find it very difficult to go elsewhere as a result. Also depending on the severity of the incident, you may be on the hook for the cost of removal to a paved road. My opinion is to treat any off-road driving activity with great responsibility and assume any damage caused is coming out of your pocket.

In short, by and large anything that doesn't happen on a recognized road/driveway/parking lot isn't covered by collision. I mean if you're parked in your yard and a tree falls, that's under comprehensive though they'll try to make your homeowner's/renter's insurance pay for it. Hitting an animal likewise falls under comprehensive.

I have had several friends learn the hard way that off-road accidents aren't covered. One rolled his truck in his yard after doing donuts a month after he bought it - then had a totaled truck that he still owed the bank on and couldn't sell or afford to repair out of pocket. Another took his WIFE'S truck on some trails with a group, and slid sideways into a tree, caved in the side of the box...not covered, he had to pay for repairs out of pocket.

I would presume that SLSDs is a bit of a gray area, some cover it, some don't, but err on the side of caution and presume yours does NOT.

Everyone should know ‘solo accidents’ always get a harder look at.

There is a way to address this.

Buy your "off-road" vehicle for cash. You don't need to have full coverage insurance on it demanded by your lender. Put liability insurance on the rig only. If you fuck it up off road, pay out of pocket to fix it (or sell it wrecked, and buy another one). Easy. No need to kiss anyone's ass.
