With the nature of a photo being static, one won't see the machinery moving. So what determination is made to ascertain whether the static machinery is working?
Hmm, I anticipated this response sooner. It's ok, I'll let it slide this time.

Working could mean it's operational - The machinery was in "working" condition. Versus a piece of rusted out crap that is sitting in a junkyard.

Or does it mean it's completing a task actively?

Do we permit the operator to take a lunch break, which I'd suggest a break is warranted.

So many questions. So few oceans to choose from.

Hmm, my excavator is on the other side of the house, I could drive my Bronco up the hill and over there, but then I would have to explain to the wife why I am working over there this afternoon, why I had to park my Bronco over there, why she has to get a picture of me working, and why she has to be sure the Bronco is in the picture too. All for you guys to disqualify me for it being my own piece of property and not technically a construction site.

I dunno, that Cat excavator has the hood up and side door open which is a clear sign that it is being serviced and not actively working. Jury is out on the red excavator as you can only see part of the boom and stick. And there doesn't seem to be an operator in the seat of the mini-ex in the background...
