I second the Mike Levine reference. You might be doing yourself and the other order holders a favor by contacting him and asking him to look into it. Your dealer may understand the error in their judgement a little bit better after communicating with him. Mike is a good guy and will definitely do whatever can be done to encourage the dealer to follow through with previously agreed upon pricing.

With the way OP wrote his post, asking for advice, it wouldn't be defamation. If he just happened to state the dealer's name, then no biggie.

Now if he came out and said that "(Dealer) is trying to steal my money and they're a bunch of crooks" then yeah, that'd be defamation.
Yeah, I didn’t say the OP did anything wrong... was saying it would be nice if they could say something without being sued. Personally, I’d like to buy a flashing billboard right in front of the dealership pointing out they are crooks... but I know better.

Are there really that many people out there that don't understand the basic, written, sales contract, when ordering a car?

I've never ordered without one.

Answer: That is correct @North7, knowledge of the basics of car buying really isn't common knowledge, the secrets are still locked away at Area 51.

DISCLAIMER: This is not to ridicule the OP, it is a general comment on the entire forum as we keep seeing new peple post things like this.

I’m almost 50, and I’ve bought many cars off lots. I’ve never ordered one before this. Likewise, I’ve never in my life signed some contract in advance. I show up, negotiate (or dont), and buy a car. Thus, while I am familiar with haggling for less than MSRP, I’m not familiar with dealers charging MORE than MSRP. But thanks for calling folks like us who were told by Ford our price was set that we are dumb.

Sorry you took it that way, I thought my sarcasm and disclaimer made that clear. As always, we all try to help each other out and that is why I posted a link.

It does not matter if it is a car, a home, house remodeling or any large purchase, always protect yourself with a written contract.

I had some emails and a DORA, but when I got VIN I insisted on a sales agreement and I paid a deposit. I wanted both the dealer and I to have skin in the game.

Im glad I did everything through email.
i almost screwed the pooch on this one myself. Originally I ordered in person and didn’t get the no ADM in writing, just verbally. It bothered me to no end so when I made my first adjustment (adding lux vs. high) I emailed my request, made mention of agreed upon msrp pricing with no add-ons or ADM. When the dealer shot back the DORA they made all the changes and responded to the pricing details…in writing. In my mind I heard Dave Chapelle say ā€œgotcha b****ā€.

If you have this happen, you should definitely lawyer up - I think the biggest risk is a court finding no harm (or applying statute of frauds or something) to you, but the scarcity of the car and the fact that they basically locked you in at one price and then adversely changed the deal opens up a couple possibilities. I also doubt it's worth it for any dealership to have to correspondingly lawyer up to defend this, and then have to deal with the bad PR. It being in writing is helpful, but it's not the end-all be-all for contracts.

I am an attorney. Never heard of having a contract to order a new car when there is a written order. I made an order. The build in the order comes to a total, reflected on the order sheet. Like ordering a pizza.

Now if you want to get all lawyery, Ford is not obligated to sell me anything because I haven’t given them any consideration yet. However, this isn’t a mom and pop used car deal or buying privately. When you order a car through a dealer, the order lists the price.

If they have the balls to add a premium, fuck ā€˜em. I won’t buy it, and I’ll tell everyone in my small town what they did. And I’ll let Ford know what their dealer did to a Day One reservation older who reserved at the price stated on the Ford site.

We all gave consideration of $100 to reserve at a set price. I have not read the small print and don’t plan to. I have enough of that to do at work. Not going to sue over a car I haven’t paid for yet. I’ll just never ever buy another Ford.

Recently I was informed by my dealer that they were changing a policy to charge ā€œmarket valueā€ rather than MSRP. I specifically went with this dealer because they originally promised they wouldn’t up charge the bronco and would only charge MSRP. Of course they made this change and informed order holders after the deadline to change dealers. Anyone else being faced with this issue? Several legal issues come to mind with this tactic not to mention consumer protection issues.
I have an email from my dealer saying they are sticking with MSRP so if they try and do this to me…….
