Eh... you don't make lawsuits like this public unless you are headed towards bankruptcy. If they had any intention on refunding preorders and trying to continue as a business, they would have keep this lawsuit private while they attempt to extract money from APG.

But they didn't, which means either they have the worse legal representation of all time. Or they're headed towards bankruptcy anyway... so screw it—let's try to drag down our old business partner with us.

Yep, this basically looks like ADV is saying if were going down, your coming with us.

Took a lot of the words out of my mouth. Everything APG said seems to be conveniently lacking facts. They took in over 4 million and didn’t know anything. What exactly were the invoices for? That’s a lot of money for distribution rights. Especially when they just put it on the internet that they always planned on selling directly anyway. In what world does a manufacturer ask for either prepayment of distribution sales or funding of the manufacturing startup. They couldn’t do it without customer funds. Period. They were both fully aware of the plan and they had a falling out when ADV couldn’t keep paying out refunds. APG will be bankrupt as well shortly and not one single top will ever be delivered to a regular customer. Anyone thinking APG is in the clear because of the contract and that statement is sorely confused.

If I was out the money I’d be suing them both because they clearly were both 100% aware of the situation and both companies had an equal share of the stolen funds. Get on it quick before neither of them has any assets.

Just reading the legal complaint, APG's response this sure seems like if/when it gets to court, it's gonna drag out long enough that if either one doesn't have deep enough pockets it could be the end for both.

One thing I will add that many might not realize is that APG appears to be a large company. Looking at their site, they appear to have large amount of "diversity" (not sure if they own all the below or just have some sort non-ownership affiliation)

gonna be hard to find, "good" class action lawyers want the big securities fraud cases, there is not a lot of $ in this overall case for a higher end attorney. Best bet is if there is an attorney (or a few) that have been harmed and sue on their own, the Judge would then pool them together to create a class and reach out to others who may have been harmed.

This might also be criminal fraud. I have the whole thread of emails telling me it's in production and many times the shipping date...and now an email and video saying 'too bad, we got your money and you are not getting a hardtop'. I'm not a lawyer, but this sure sounds like criminal fraud. Stay tuned.

Where this ends up will be interesting. Just because ADV posted their lawsuit in the open before APG could post anything does not mean they were wronged. APG response does not mean they were wronged. As they say, it's your side, their side, and the truth.

I believe that ADV may come out on the short end here. Their own documents show and support what APG statement was, and I am not sure who ADV lawyers are, but that filing was not from a top flight law firm.

No skin in the game, I'll just monitor how this ends, and chuckle at all the people jumping on and off the train trying to make a quid from it.

So what will the total cost of the top be now? $7k top/freight, lawyer fees, more lawyer fees, buying an actual real top that is actually produced- $5k. Man this top is adding up quickly.

All I know is I'm glad I got out in April (after waiting 2 years) and got on the TurnTop list.
