Nearly all states regulate by bumper height, not tire size. There's a few other things to consider, but if it were not acceptable in the majority of states, it wouldn't be a production vehicle.
That being said, I'm curious to which state you saw this video.
I understand (and could be wrong) that the 4-door has a cargo system upgrade that will include a management for the four doors. 2-door apparently will not have the room.

My guess as well. I've been trying to build my perfect trim setup - and can't - (until proven otherwise in the future builder) which I assume is the marketing purpose. Convince people to buy more for the one detail they really want.
They're not all linear improvements in trim, Wildtrak is a dune-runner (speed for sand not rocks), Badlands is more robust (steel bumpers + armor) and better for slower trailing and crawling (2.3L standard, sway bar disconnect, etc).
So yeah, the Badlands might be your preferred trim,
