It does have some flex but I'm a big guy, sat on it, and don't have any concerns about it breaking. It does create a section apart from the bins where I store first aid, flat tool cases, and a few safety things so it feels supportive without crushing any of that.

I'm an insurance agent and never have issues in my market with them. I refer clients often and definitely wouldn't if that wasn't the case. I'm sure it's like anything else, depends on where you are and who runs that shop.
I'd be pissed too, but you don't need to hire a lawyer to deal with this. If they claim not responsible, file a comp claim and your insurance company will subrogate.
